Plain-language summary: LocalPulse is a location-based community app. By using it, you agree to post only lawful, appropriate content; share your location only as you choose; treat other community members with respect; and understand that you — not LocalPulse — are responsible for your real-world interactions. By creating an account or using LocalPulse (the "App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and LocalPulse, LLC ("we," "us," or "our"). We reserve the right to update these Terms at any time; continued use after notice of changes constitutes acceptance.
You must be at least 13 years old to use LocalPulse. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts of users who misrepresent their age.
3.1 Voluntary location sharing. LocalPulse is a location-based service. When you create a post, your general geographic area is associated with that post and visible to other users within your selected radius. You control your radius and can use the "Fuzzy Location" setting to share only your approximate zone rather than precise coordinates.
3.2 Serendipity Pings. When your Hooks (interest tags) match a nearby post, we may notify you with a Serendipity Ping disclosing that relevant activity is occurring near you. Your precise location is never shared with the poster — only that you are within the active radius.
3.3 What we collect. We collect the location data you provide when posting, your account information, usage activity, and device identifiers. We do not sell your personal data to third parties. We may share aggregate, anonymized data for analytics purposes. See our Privacy Policy for full details.
3.4 Anonymous posting. The anonymous posting feature hides your identity from other users. However, we retain the ability to identify the account behind anonymous posts when required by law, court order, or to investigate violations of these Terms. Anonymity is a display feature, not a guarantee of legal anonymity.
3.5 Data retention. You may delete your account at any time. Upon deletion, your posts, location data, and personal information will be removed from public view within 30 days. Aggregate or anonymized data may be retained longer. Backups may retain data for up to 90 days after deletion.
4.1 Real-world interactions. LocalPulse facilitates connections between people in your local community. You acknowledge that meeting people you connect with through the App involves inherent real-world risk. LocalPulse does not screen, verify, or background-check users. You assume full responsibility for any in-person interactions that occur as a result of using the App.
4.2 Location safety. Sharing your location, even in approximate form, carries risks. Do not share precise location information (such as your home address or daily routine) in your posts. Be aware that repeated posts from the same location may allow others to infer your location over time.
4.3 No liability for interactions. LocalPulse, LLC is not responsible for the conduct of any user, online or offline. We expressly disclaim all liability for harm, injury, loss, or damage arising from or related to meetings, communications, or interactions with other users, whether facilitated through the App or otherwise.
4.4 Reporting. You can report any post or user that makes you feel unsafe using the Report function. We take safety reports seriously and will investigate promptly. For immediate safety threats, contact local emergency services (911) — do not rely on the App.

We reserve the right to remove any content and suspend or terminate any account that violates these terms, at our sole discretion, without notice.
6.1 Your content. You retain ownership of content you post. By posting, you grant LocalPulse, LLC a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within the App and in connection with marketing LocalPulse.
6.2 Our content. The LocalPulse name, logo, design, and software are owned by LocalPulse, LLC and protected by intellectual property law. You may not use them without our express written permission.
6.3 DMCA. We respect intellectual property rights. If you believe content on the App infringes your copyright, contact us at support@localpulsellc.app with a description of the allegedly infringing content and your contact information.
Content shared to your Inner Circle or to a Group is intended for a limited audience. While we implement technical measures to restrict visibility, we cannot guarantee absolute privacy of Circle or Group content. Do not share information in your Circle or Groups that you would not be comfortable with others potentially seeing. Members of your Circle or Group may screenshot, share, or disclose content outside of the App.
8.1 "As is." The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
8.2 Limitation of liability. To the fullest extent permitted by law, LocalPulse, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.
8.3 Cap on damages. Our total liability to you for any claim arising out of these Terms or your use of the App shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
8.4 Essential basis. You acknowledge that the limitations in this section are an essential element of the agreement between us, without which we would not provide the App.
You agree to indemnify, defend, and hold harmless LocalPulse, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your content; or (d) your violation of any rights of another person.
10.1 Informal resolution. Before filing any legal claim, you agree to contact us at support@localpulsellc.app and attempt to resolve the dispute informally for at least 30 days.
10.2 Binding arbitration. If informal resolution fails, disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive the right to a jury trial and to participate in a class action.
10.3 Exceptions. Either party may seek injunctive or other equitable relief in court to prevent irreparable harm, and you may bring claims in small claims court if they qualify.
10.4 Governing law. These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
We may suspend or terminate your account at any time for any reason, including violation of these Terms, with or without notice. You may delete your account at any time through the Profile settings. Sections 6, 8, 9, and 10 survive termination.
